Supreme Council of the Autonomous Republic of Adjara, Election procedure and Powers


The Supreme Council of the Autonomous Republic of Adjara is the highest representative body of the Autonomous Republic of Adjara, which, within the powers of the Autonomous Republic of Adjara, carries out legislative activity, supervises the government of the Autonomous Republic of Adjara and exercises other powers defined by law.

The Supreme Council consists of no more than 21 deputies elected for a term of 4 years. The Supreme Council is elected by secret ballot on the basis of universal, equal and direct suffrage by Georgian citizens registered in the territory of the Autonomous Republic of Adjara.

The next elections of the Supreme Council are held on the last Saturday of October of the calendar year in which the term of office of the Supreme Council expires. If a state of war is declared either throughout the territory of Georgia or a state of emergency is declared on the territory of the Autonomous Republic of Adjara, the elections of the Supreme Council shall be held within 60 days from the lifting of the state of emergency or state of war. The President of Georgia shall call the elections in the manner prescribed by Georgia's organic law no later than the 60th day before the elections.

A citizen of Georgia with the right to vote who is at least 25 years old and who has resided in Georgia for at least 5 years may be elected as a member of the Supreme Council. A person sentenced to imprisonment by a court may not be elected as a member of the Supreme Council.

The number of deputies of the Supreme Council is determined by the Constitution of the Autonomous Republic of Adjara, and the procedure for their election is determined by the legislation of Georgia and by the Constitution and legislation of the Autonomous Republic of Adjara. The final protocol of the Supreme Council elections shall be drawn up by the Supreme Election Commission of the Autonomous Republic of Adjara in the manner prescribed by the legislation of Georgia and of the Autonomous Republic of Adjara.

The first session of the Supreme Council shall be held no later than one month after the elections and shall be convened by the President of Georgia. The Supreme Council shall commence its work if the mandates of no fewer than two-thirds of its members have been confirmed.

A member of the Supreme Council shall not have the right to simultaneously be a member of another representative body or a member of the Government of the Autonomous Republic of Adjara. Other cases of incompatibility shall be determined by the legislation of Georgia, by the Constitution of the Autonomous Republic of Adjara and by the Supreme Council'sregulations.

The Supreme Council:

a) adopts the Constitution of the Autonomous Republic of Adjara and the Autonomous Republic of Adjara's

other laws;

b) approves the Government of the Autonomous Republic of Adjara;

g) is authorized, by a majority of the full membership, to express no confidence in the Government of the Autonomous Republic of Adjara;

d) by a majority of the full membership adopts the budget of the Autonomous Republic of Adjara

law;

e) establishes the awards and honorary titles of the Autonomous Republic of Adjara;

v) exercises other powers defined by this law, by the legislation of Georgia, by the Constitution of the Autonomous Republic of Adjara and by the legislation of the Autonomous Republic of Adjara.
